WarehouseOS™ Software-as-a-Service Platform

Your Privacy Matters. This Privacy Policy describes how Warehouse Mobile Solutions, LLC (“Company,” “we,” “us,” or “our”) collects, uses, discloses, and protects information in connection with the WarehouseOS software-as-a-service platform (the “Service”), our website, and any related services. By using our Service, you agree to the collection and use of information in accordance with this Privacy Policy. 

1. Scope of This Privacy Policy

This Privacy Policy applies to all users of the WarehouseOS platform, including Customer administrators, authorized end users, and visitors to our website. It covers information collected through the Service, our website, email communications, and any other interactions you may have with us. 

This Privacy Policy does not apply to third-party websites, applications, or services that may be linked from or integrated with the Service. We encourage you to review the privacy policies of any third-party services before providing them with your information.

We collect information that you voluntarily provide to us when you register for and use the Service, including: 

  • Account Information: Company name, contact name, email address, phone number, billing address, and administrative user credentials created during the registration process. 
  • Billing Information: Payment card details, billing address, and other financial information necessary to process payments for the Service. Payment processing may be handled by third-party payment processors. 
  • Customer Data: Any data you upload, input, or otherwise provide to the Service in the course of using WarehouseOS, including warehouse operations data, inventory records, transaction data, and other business information. 
  • Communications: Information you provide when you contact our support team, respond to surveys, or otherwise communicate with us.

2.2 Information Collected Automatically

When you access or use the Service, we automatically collect certain information, including: 

  • Usage Data: Information about how you interact with the Service, including features accessed, pages viewed, actions taken, timestamps, frequency of use, and performance metrics. 
  • Device and Connection Information: IP address, browser type and version, operating system, device identifiers, screen resolution, and network information. 
  • Log Data: Server logs that record requests made to our systems, including the date and time of the request, referring URL, and system activity. 
  • Cookies and Similar Technologies: We use cookies, web beacons, and similar tracking technologies to collect information about your browsing activity and preferences. See Section 9 (Cookies and Tracking Technologies) for more details.

2.3 Information from Third Parties

We may receive information about you from third-party sources, such as business partners, marketing partners, data providers, or publicly available sources. This information may be combined with other information we collect about you.


3. How We Use Your Information

We use the information we collect for the following purposes:

Analytics and Improvement To analyze usage patterns and trends to improve the Service, develop new features, and enhance user experience.
Security To detect, prevent, and address technical issues, fraud, and security threats.
Communications To send you service-related notices, updates, security alerts, and administrative messages.
Legal Compliance To comply with applicable laws, regulations, legal processes, or governmental requests.
Aggregate Insights To compile aggregate or de-identified data for business analysis, benchmarking, and improving our offerings.

As described in our General Terms and Conditions of Sale, Company shall have the right to collect and analyze data relating to the provision, use, and performance of the Service and related systems and technologies, and to use such information to improve and enhance the Service and for other development, diagnostic, and corrective purposes. Company may disclose such data solely in aggregate or other de-identified form in connection with its business.


4. Legal Bases for Processing

We process your personal information based on the following legal grounds: 

Contractual Necessity: Processing necessary to perform our obligations under the Agreement (including the Proposal and Terms and Conditions of Sale) with you or your organization.

Legitimate Interests: Processing necessary for our legitimate business interests, such as improving the Service, fraud prevention, and network security, provided these interests are not overridden by your rights.

Consent: Where you have given us specific consent to process your information for a particular purpose.

Legal Obligation: Processing necessary to comply with applicable laws and regulations.


5. Data Sharing and Disclosure

We do not sell your personal information. We may share your information in the following circumstances:

  • Service Providers: We may share information with trusted third-party service providers who perform services on our behalf, such as hosting, payment processing, analytics, and customer support. These providers are contractually obligated to use your information only as necessary to provide services to us and in accordance with this Privacy Policy.

  • Affiliated Entities: We may share information with our affiliated entities for purposes consistent with this Privacy Policy.

  • Legal Requirements: We may disclose information if required to do so by law or in response to valid legal process, such as a subpoena, court order, or government request.

  • Protection of Rights: We may disclose information when we believe disclosure is necessary to protect our rights, property, or safety, or the rights, property, or safety of our users or others.

  • Business Transfers: In the event of a merger, acquisition, reorganization, bankruptcy, or other similar event, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

  • Aggregate and De-identified Data: We may share aggregate or de-identified information that cannot reasonably be used to identify you, for purposes including industry analysis, benchmarking, and marketing.


6. Customer Data

Customer owns all right, title, and interest in and to Customer Data, as well as any data that is based on or derived from the Customer Data and provided to Customer as part of the Service. We process Customer Data on behalf of and at the direction of our Customers. 

Customer Data is treated as Proprietary Information of the Customer and is subject to the confidentiality obligations set forth in our General Terms and Conditions of Sale. We will not access, use, or disclose Customer Data except as necessary to provide the Service, as authorized by the Customer, or as required by law.

6.1 Data Access Methods

Customers can access and export their Customer Data at any time through the following methods at no additional charge: CSV export through the WOS Manager interface and programmatic access via the WarehouseOS API. Customers who subscribe to the optional WOS Insights add-on also have access to pre-built reports and dashboards. 

6.2 Data Portability

Upon termination or expiration of the Agreement, Company will make all Customer Data available for electronic retrieval in CSV format for a period of thirty (30) days following the effective termination date. After this period, Company may delete all Customer Data from its systems.


7. Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy any legal, accounting, or reporting requirements. The retention period may vary depending on the context and our obligations. 

Specifically:

  • Account Information: Retained for the duration of the active account and for a reasonable period thereafter to comply with legal obligations and resolve disputes.

  • Customer Data: Retained for the Term of the Agreement and for thirty (30) days after termination, after which it may be deleted.

  • Usage and Log Data: Retained for up to [specify period, e.g., 24 months] from the date of collection for analytics and security purposes.

  • Billing Records: Retained for the period required by applicable tax and financial regulations. 


8. Data Security

We implement and maintain reasonable physical, administrative, and technical safeguards designed to protect your information from unauthorized access, use, alteration, and destruction. These measures include, but are not limited to:

  • Encryption of data in transit and at rest; 
  • Access controls and authentication mechanisms; 
  • Regular security assessments and vulnerability testing; 
  • Employee training on data protection and security practices; and 
  • Incident response and breach notification procedures.

While we strive to protect your information, no method of transmission over the Internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your information.


9. Cookies and Tracking Technologies

We use cookies and similar tracking technologies to collect and store information when you use the Service or visit our website. Cookies are small data files stored on your device.

9.1 Types of Cookies We Use

  • Essential Cookies: Necessary for the operation of the Service, including authentication and session management. 
  • Analytics Cookies: Help us understand how users interact with the Service, enabling us to improve functionality and user experience. 
  • Preference Cookies: Allow us to remember your settings and preferences for a more personalized experience.

You can control and manage cookies through your browser settings. Please note that disabling certain cookies may affect the functionality of the Service. Most browsers allow you to refuse cookies, delete existing cookies, or alert you when a cookie is being set.

Depending on your location and applicable law, you may have certain rights regarding your personal information, including:

  • Right to Access: You may request a copy of the personal information we hold about you. 
  • Right to Correction: You may request that we correct inaccurate or incomplete personal information. 
  • Right to Deletion: You may request that we delete your personal information, subject to certain exceptions. 
  • Right to Data Portability: You may request a copy of your personal information in a structured, commonly used, and machine-readable format. 
  • Right to Opt-Out: You may opt out of certain data processing activities, including the sale of personal information (we do not sell personal information) and targeted advertising. 
  • Right to Restrict Processing: You may request that we restrict the processing of your personal information in certain circumstances. 
  • Right to Withdraw Consent: Where processing is based on consent, you may withdraw your consent at any time.

To exercise any of these rights, please contact us using the information provided in Section 15. We will respond to your request within the timeframe required by applicable law.


11. California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”). 

Consistent with our General Terms and Conditions of Sale, any personal information protected under the CCPA collected or otherwise accessible by Company shall be used solely for the benefit of Customer and shall not be sold or otherwise disclosed by Company to any third party, or used in violation of the CCPA. 

California residents may:

  • Request to know what personal information we collect, use, disclose, and sell; 
  • Request deletion of their personal information; 
  • Request correction of inaccurate personal information; 
  • Opt out of the sale or sharing of personal information (we do not sell personal information); and 
  • Not be discriminated against for exercising any of these rights.

To submit a request, please contact us using the information in Section 15. We may need to verify your identity before processing your request.


12. International Data Transfers

The Service is hosted and operated in the United States. If you access the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. 

By using the Service, you consent to the transfer of your information to the United States. Where required by applicable law, we will implement appropriate safeguards, such as standard contractual clauses, to protect your information during international transfers. 

As noted in our Terms and Conditions, Customer may not remove or export from the United States or allow the export or re-export of the Service, Software, or anything related thereto in violation of any restrictions, laws, or regulations of the United States or any other applicable jurisdiction.


13. Children’s Privacy

The Service is designed for business use and is not directed at individuals under the age of 16. We do not knowingly collect personal information from children under 16. If we become aware that we have collected personal information from a child under 16, we will take steps to delete that information promptly. If you believe a child under 16 has provided us with personal information, please contact us using the information in Section 15. 


14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, the Service, or applicable laws. When we make material changes, we will notify you by posting the updated policy on our website and updating the “Last Updated” date at the top of this document. For significant changes, we may also provide additional notice, such as an email notification or an in-Service announcement. 

Your continued use of the Service after any changes to this Privacy Policy constitutes your acceptance of the updated policy. We encourage you to review this Privacy Policy periodically.
